These Terms of Service ("Terms") govern your access to and use of operationappeal.com (the "Service"), operated by OperationAppeal LLC, a California limited liability company ("OperationAppeal," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not access or use the Service.
1. The Service
OperationAppeal provides an AI-powered tool that helps U.S. military veterans analyze claim denials, rating decisions, and Explanation of Benefits (EOB) documents related to Department of Veterans Affairs (VA) disability benefits, TRICARE, CHAMPVA, and related veteran health insurance programs. When you upload a document, the file is processed in your browser first, then transmitted via our secure backend to an enterprise AI provider for analysis. OperationAppeal does not retain the original document. We log scrubbed case metadata and scrubbed text excerpts to help improve the Service. See our Privacy Policy.
2. No Legal Advice; No Attorney-Client Relationship
The Service provides information and analysis, not legal advice. Use of the Service does not create an attorney-client relationship.
Information you submit may be analyzed by third-party artificial intelligence systems as described in our Privacy Policy. Do not rely solely on the Service for decisions about your VA claim, health insurance appeal, or any other legal matter. Always verify information with a licensed attorney, VA-accredited representative, or Veterans Service Organization (VSO) before acting. Filing deadlines, eligibility requirements, and regulations change.
3. AI-Generated Content; Accuracy Disclaimer
The Service uses artificial intelligence to generate analysis. AI systems can produce inaccurate, incomplete, or fabricated output (sometimes called "hallucinations"). OperationAppeal does not guarantee the accuracy, completeness, or timeliness of any content produced by the Service. You are solely responsible for verifying any output before relying on it — regulatory citations (38 CFR, 38 U.S.C., state codes), case law, filing deadlines, procedural requirements, and factual representations about your circumstances.
4. Eligibility & Acceptable Use
You must be at least 18 years of age to use the Service. By using the Service, you represent that you have the legal capacity to enter into these Terms and that your use complies with applicable law in your jurisdiction.
You agree not to:
- Use the Service for any unlawful purpose or to violate any applicable law or regulation;
- Upload classified, export-controlled, or otherwise restricted information;
- Upload documents you do not have the right to share (including others' medical records without authorization);
- Reverse-engineer, scrape, or attempt to extract proprietary systems of the Service;
- Bypass security controls, exceed rate limits, or disrupt the Service's operation; or
- Resell, sublicense, or commercially redistribute the Service without our written consent.
5. No Fees
The Service (document analysis, appeal letter drafting, and information retrieval) is offered free of charge. No payment is required.
6. Intellectual Property
The Service is the property of OperationAppeal or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use in connection with your own veteran benefits matters.
You retain all rights in documents you upload. By uploading, you grant OperationAppeal a limited license to process the document through third-party AI systems solely to provide the Service to you. We do not claim ownership of your documents. Aggregated, anonymized metadata derived from Service usage is owned by OperationAppeal and may be used for research and product improvement.
7. Unauthorized Practice of Law Notice
OperationAppeal is not a law firm and does not provide legal representation. Representation of veterans before the VA requires accreditation under 38 C.F.R. § 14.629. As of the effective date of these Terms, OperationAppeal's founder is pursuing accreditation as a VA Claims Agent but is not yet accredited. No fees are charged for the Service.
California residents: OperationAppeal's founder is not a licensed attorney in California or any other state. Under California Business and Professions Code § 6125, only active members of the State Bar of California may practice law in California. Use of the Service does not constitute the practice of law. If your matter requires legal representation, you should consult a licensed attorney or VA-accredited representative.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, OperationAppeal disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and completeness. OperationAppeal makes no warranty that the Service will be uninterrupted or error-free, that defects will be corrected, that output will be accurate or current, that the Service will meet your requirements or result in any particular outcome, or that the Service is free from viruses or harmful components.
9. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall OperationAppeal, its founder, officers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, loss of benefits, business interruption, or denied claims, arising out of or in connection with the Service or these Terms. OperationAppeal's total cumulative liability to you shall not exceed the greater of one hundred U.S. dollars ($100) or the total fees you have paid OperationAppeal in the twelve months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless OperationAppeal, its founder, and its affiliates from any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law; or (d) your infringement of any third-party right.
11. Dispute Resolution; Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by JAMS in accordance with the JAMS Comprehensive Arbitration Rules and Procedures. The arbitration shall be conducted by a single neutral arbitrator in San Diego County, California, or at another mutually agreed location.
Class action waiver. You agree any dispute shall be resolved on an individual basis. You waive any right to participate in a class action, collective action, consolidated action, or representative proceeding.
Notwithstanding the foregoing, either party may bring an individual action in small-claims court, and either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent unauthorized use or disclosure of confidential information or intellectual property.
12. Governing Law; Venue
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-laws principles. Except as provided in Section 11 (arbitration), any legal action arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in San Diego County, California.
